Terms of Service

1. Acceptance of Terms

By accessing or using ServiceBooked ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. You must be at least 18 years old, and authorized to enter into these terms on behalf of any business you represent.

2. Description of Service

ServiceBooked is an AI receptionist platform for service-based businesses. The Service includes:

  • An AI voice receptionist that answers calls, qualifies leads, and books appointments
  • An AI chat widget for your website that converses with visitors and books appointments
  • Two-way SMS messaging with automated replies and missed-call auto-text
  • Customer relationship management (contacts, tags, pipelines, notes)
  • Calendar integration with Google Calendar and similar providers
  • Workflow automation (reminders, follow-ups, review requests, lead nurture)
  • A dashboard for reviewing conversations, appointments, and analytics

Features available on your account depend on your plan. We may add, change, or remove features over time.

3. Account Registration

You must create an account to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

4. Free Trial

New accounts are eligible for a 14-day free trial on the plan they choose at signup. A valid credit or debit card is required to start the trial. We do not charge the card during the trial.

At the end of the 14-day trial, your subscription continues automatically at the plan price you selected, billed to the card on file, unless you cancel before the trial ends. Cancellation is one click from your billing settings and takes effect immediately — you keep access through the end of the trial, and you are not charged.

If your card is declined when the trial converts, your account enters a payment-failure state and you have a short grace period to update your payment method before access is suspended.

Extended trials may be granted at our discretion through invitation links. The terms of an extended trial are otherwise identical to the standard 14-day trial.

5. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or any communications in violation of applicable law
  • Violate the U.S. Telephone Consumer Protection Act (TCPA), Canada's Anti-Spam Legislation (CASL), or equivalent rules in your jurisdiction
  • Send messages on behalf of categories prohibited by U.S. carriers under SHAFT (Sex, Hate, Alcohol, Firearms, Tobacco) or other carrier policies
  • Contact recipients who have not consented to receive messages from your business, or who have opted out
  • Infringe on the intellectual property, privacy, or publicity rights of others
  • Transmit harmful, fraudulent, deceptive, or illegal content
  • Reverse-engineer, scrape, or attempt to disrupt the Service
  • Use the Service to build a competing product

6. SMS and Telephony Compliance

You are responsible for obtaining the consent required by law before adding a recipient to any messaging workflow run by the Service. Specifically:

  • You must have prior express consent (or another lawful basis under TCPA / CASL) to send commercial messages to a phone number
  • Every recipient must be able to opt out by replying STOP; the Service honors STOP, UNSUBSCRIBE, CANCEL, END, and QUIT automatically
  • Replying HELP returns information about your business and how to reach you
  • You must register your business and brand with carriers (10DLC in the U.S.) where required, and you must keep that registration accurate
  • You must comply with any call-recording disclosure laws applicable to the jurisdictions you operate in. The Service can play a recording-disclosure greeting on the AI voice receptionist; you are responsible for keeping it enabled where required.

We may suspend SMS or voice features on accounts that generate excessive complaints, opt-outs, or carrier violation reports.

7. Customer Data

Information you collect from your customers through the Service (contacts, conversations, recordings, bookings) belongs to you and your customers. We process it on your behalf to operate the Service, as described in our Privacy Policy. You are responsible for having a lawful basis to collect and process that information.

8. Payment and Billing

Paid plans are available on monthly or annual terms. By starting a paid subscription, you authorize us to charge your payment method on a recurring basis until you cancel. Subscriptions renew automatically at the end of each billing period.

You can cancel at any time through your billing settings; cancellation takes effect at the end of the current billing period and you retain access through that date. We do not provide refunds for partial billing periods or unused time. Some usage-based costs (for example, message volume above plan limits) may be billed in arrears.

Card details are collected and stored by our payment processor, Stripe. We never see or store your full card number.

9. Third-Party Services

The Service depends on third-party providers (Twilio, Vapi, Google, Stripe, and others listed in our Privacy Policy). Outages, rate limits, or policy changes by those providers can affect availability. We are not responsible for failures caused by third-party services outside our reasonable control.

10. AI Output

The Service uses AI to converse with your customers and summarize calls and chats. AI output can be inaccurate, incomplete, or unexpected. You are responsible for reviewing AI-generated bookings, summaries, and replies before relying on them, and for configuring your AI instructions to reflect your business policies.

11. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms, that fail to pay, or that pose risk to the Service or to other users. On termination, your access ends and your data is deleted in accordance with the retention schedule in our Privacy Policy.

12. Limitation of Liability

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, and we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the twelve months before the claim arose.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
